PUBLIC OFFER FOR THE CONCLUSION OF A CONTRACT FOR THE RETAIL SALE OF FLOWERS This document is a public offer (hereinafter referred to as the "Offer") addressed to any individual (hereinafter referred to as the "Buyer") expressing the intention to conclude a retail purchase and sale agreement with Empire of Flowers LLP (hereinafter referred to as the "Seller"), on the terms set out below. 1. GENERAL PROVISIONS 1.1. This Offer defines the procedure for the retail sale of flowers and related products through the Seller's online store. 1.2. Placing an order by the Buyer in the online store means full and unconditional acceptance of the terms of this Offer. 1.3. This offer is drawn up in accordance with the legislation of the Republic of Kazakhstan. 2. SUBJECT OF THE AGREEMENT 2.1. The Seller undertakes to transfer the ownership of the floral products and related products to the Buyer (hereinafter referred to as the "Product"), and the Buyer undertakes to pay for and accept the Goods in accordance with the terms of this Offer. 2.2. The appearance of the Product, its color scheme and composition may differ slightly from the images on the website, as each flower arrangement is unique. 2.3. All Product specifications and descriptions are listed in the online store's catalog, but are subject to change without prior notice. 3. THE ORDER PROCESSING PROCEDURE 3.1. The Order is placed through the online store's website by adding the Product to the cart and filling in the Buyer's contact details. 3.2. After placing the order, the Buyer receives an automatic confirmation by phone or e-mail, as well as a call from the manager to clarify the details of the order. 3.3. If it is impossible to fulfill the order according to the data specified by the Buyer, the Seller has the right to cancel the order with a refund if the payment has been made. 4. TERMS OF PAYMENT 4.1. Payment for the Goods is carried out through bank cards, electronic payment systems or other methods specified on the website. 4.2. Payment is possible both by prepayment and upon receipt (if such an option is available in the delivery region). 4.3. When paying online, payments are processed through secure payment gateways. 4.4. The Seller does not store Customer's bank card data, all payments are made through certified payment systems. 5. DELIVERY AND RECEIPT 5.1. Delivery is carried out in accordance with the conditions specified on the website. 5.2. The Buyer is obliged to provide accurate information for delivery. In case of errors in the address, there may be delays or the impossibility of delivery without a refund of the order value. 5.3. Delivery is carried out within the time period specified on the website. Extended delivery times are possible during the holidays. 5.4. The Seller is not responsible for delays caused by the actions of third parties (courier services, weather conditions, etc.). 5.5. If the recipient refuses to accept the order, it is considered completed, and no refund is made. The further fate of the bouquet remains at the discretion of the customer. The seller and the courier service are not responsible for its safety, transfer to third parties or other disposal. 6. REFUND AND CANCELLATION OF THE ORDER 6.1. According to the legislation, flowers and live plants are not subject to return and exchange. 6.2. In case of detection of defects in the Product, the Buyer has the right to file a claim on the day of receipt of the order by sending a photo and video recording to the Seller's contact information. 6.3. In case of cancellation of the paid order 24 hours before the delivery time, 100% of the payment amount will be refunded to the Buyer. 6.4. In case of cancellation in less than 24 hours, a refund is partially possible depending on the stage of preparation of the order. 6.5. The seller reserves the right to refuse a refund if there is evidence that the order has been completed of proper quality. 7. PERSONAL DATA PROTECTION 7.1. The Seller undertakes to store and process the Buyer's personal data in accordance with the privacy policy. 7.2. Personal data is not transferred to third parties, except in cases stipulated by law. 7.3. The Seller is not responsible for data leakage as a result of actions of third parties. 8. RESPONSIBILITY OF THE PARTIES 8.1. The Seller is not responsible for incorrect information provided by the Buyer when placing the order. 8.2. The Seller is not responsible for force majeure circumstances that prevent the fulfillment of obligations under this Offer. 8.3. The Seller is not responsible for the actions of third parties, including courier services, banks and payment systems. 8.4. The Buyer is solely responsible for the accuracy of the data provided. 9. OTHER CONDITIONS 9.1. The Seller reserves the right to make changes to the Offer without prior notice to the Buyers. 9.2. The current version of the Offer is always available on the website of the online store. 9.3. By placing an order, the Buyer confirms his full agreement with the terms of this Offer and understands that the purchase of flowers is an individual order, possible variations of which he accepts. Acceptance of this Offer means that the Buyer agrees to all its terms.
